性工作者為何受不到應有的保護?



     娼妓是人類最古老的行業之一,和其他行業一樣,有需求便有供應,歷久不衰。走遍世界每個角落,何處沒有它的蹤跡?

     開明的國家早已把這個行業合法化,使從事性工作者能在安全的環境下提供服務,不受非法之徒威廹利誘,敲詐勒索;也使光顧此類服務的人可光明正大和妓女妓男公平交易,各取所需,不受中間剝削。

     加拿大法律不容許經營妓院,把娼妓迫上街頭,在缺乏適當保護的環境下向陌生人兜售肉體。不法之徒便有機可乘,設下陷阱,讓妓女妓男自投羅網,受騙,受害:輕者,金錢損失;重者,生命不保。温哥華高貴林港(Port Coquitlam)養豬場之多宗命案,便是令人髮指的冷血謀殺。假設這些妓女是在妓院內幹活,僱有保鏢保護,那個有預謀的兇手又怎能輕易向她們下毒手呢?

     加拿大法律沒有取締街頭賣淫,却不容許經營妓院,試問這樣立法是跟據什麼邏輯呢?有說容許妓院存在會影響居民的正常生活和社會安寕,如果屬實,怎不考慮設立「紅燈區」?使買賣雙方可按圖索驥,在有規範的環境下進行交易。很多北歐、西歐國家和新加坡都設立了紅燈區,行之有效,加拿大可借鏡。

     有些假衛道之士支持加拿大對管理娼妓之立法,認為性工作者如感到人身安全受威脅,可選擇離開這個行業。他們一直以為面對重重陷阱有阻嚇作用,使業者知難退出,新人却步。殊不知法律存在不少弱點,既不能減少罪案之發生,也勸導不了娼妓從良。由此看來,崇高的理想改變不了醜惡的現實。立法袞袞諸公,有重新面對現實的必要,快點調整你們的思維。否則如養豬場之悲劇會繼續上演,於心何忍!

     加拿大法律也不容許在街頭賣淫的妓女僱用司機或保鏢,認為這些僱員受惠於賣淫所得是非法行為,觸犯剝削之罪。法律不近人情之處何止於此:它禁止妓女與嫖客公開討價還價,剝奪她們挑選嫖客和商議避孕袋使用的權利。一面倒地限制妓女之自保,使法律的公正失去了平衡。

     娼妓行業的存在是由於很多社會因素做成的,不能徹底禁止。既然如此,政府有責任去保護從事這個行業的人,絕不可歧視他們。現行的法律有重新修定的必要,急不容緩。

    I always feel that prostitution should be legalized. Let’s face it. Can we expect young growing males to abstain from sex until they get married!? Without sex for sale, they will only work on family girls or go rape women. In Holland and many other European countries, brothels operate legally. In Taiwan, they have the Peitau sex District. In Hong Kong, they have that Yat Lau Yat Fung (One house one “phoenix”) operations. In fact, prostitutes operate in every corner on earth irrespective it’s considered a crime in most countries.

  2. I agree that there should be a legal red light district. But it should be highly supervised by the enforcement agencies, police and health care personnel. It's easier said than done. If the business is lucrative, you get the organized crime muscling in for their part of the profits. HIV is prevalent among sex workers. so
    they need to be checked on a regular basis. How will the girls be paid, and who checks the books on these brothels? Will legalizing prostitution satisfy the conservatives and fundamentalist Christians that are a large segment of the Canadian population? Instead of facing reality, I think most will turn a
    blind eye and act as if it doesn't exist. Ha ha.
